I. INTERMEDIARY STATUS & SAFE HARBOUR

Intermediary Declaration

RaahiOne Mobility Private Limited is an “Intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000. The Platform acts solely as a facilitator providing access to a technology platform that enables Users to connect with each other.

RaahiOne does not initiate, select, modify, or control any information, content, communication, or transaction shared between Users and does not assume responsibility for such content.

RaahiOne claims safe harbour protection under Section 79 of the Information Technology Act, 2000 and shall not be liable for any third-party information, data, or communication hosted or transmitted through the Platform, subject to compliance with applicable law.

II. USER-GENERATED CONTENT & PROHIBITED ACTIVITIES

User Responsibility for Content

All information, messages, listings, profiles, images, locations, and communications shared on the Platform are user-generated content. Users are solely responsible for the legality, accuracy, and consequences of such content.

Prohibited Content and Conduct

Users shall not upload, post, transmit, or engage in any activity that:

  • Is unlawful, fraudulent, or misleading
  • Is defamatory, abusive, harassing, hateful, or threatening
  • Promotes violence, terrorism, or anti-national activities
  • Infringes intellectual property rights
  • Involves impersonation or misrepresentation
  • Involves transportation of prohibited, illegal, hazardous, or restricted items
  • Violates any applicable law or regulation

RaahiOne reserves the right to remove or restrict access to such content upon receipt of a lawful order or actual knowledge as required under law.

III. GRIEVANCE REDRESSAL MECHANISM

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, RaahiOne has appointed a Grievance Officer.

All complaints shall be acknowledged and resolved within the timelines prescribed under applicable law.

IV. DATA PROTECTION & PRIVACY (DPDP ACT, 2023)

Personal Data Processing

RaahiOne collects and processes personal data such as name, phone number, location data, device information, driving licence details (if provided), and communication logs solely for lawful purposes including account creation, service facilitation, safety, compliance, and legal obligations.

Personal data is processed based on user consent or other lawful grounds permitted under the Digital Personal Data Protection Act, 2023.

User Rights

Users have the right to:

  • Access their personal data
  • Request correction or updating of inaccurate data
  • Request erasure of personal data, subject to legal obligations
  • Withdraw consent at any time

Requests may be submitted through the Platform or via the registered contact email.

Children’s Data

Personal data of users below 18 years of age shall be processed only with consent of a parent or legal guardian. RaahiOne does not engage in targeted advertising directed at children.

V. LOCATION, GPS & NAVIGATION DISCLAIMER

The Platform may use GPS, maps, and location-based services. Location data, routes, distances, and navigation information may be inaccurate or incomplete due to technical limitations.

RaahiOne shall not be liable for incorrect navigation, wrong pick-up or drop-off points, route deviations, delays, or safety issues arising from reliance on location data.

VI. USER SAFETY & BACKGROUND DISCLAIMER

RaahiOne does not conduct police verification, criminal background checks, or behavioural screening of Users.

Users are solely responsible for assessing the suitability, safety, and trustworthiness of other Users before accepting rides or deliveries. RaahiOne does not guarantee the conduct, character, identity, or background of any User.

VII. PRIVATE RIDE-SHARING CLARIFICATION

The Platform facilitates private ride-sharing and cost-sharing between Users. It is not a commercial taxi service or transport operator.

RaahiOne does not provide commercial permits, fare meters, or transportation services. Any violation of transport, tax, or motor vehicle laws shall be the sole responsibility of the User involved.

VIII. FUTURE FEES & MONETIZATION

RaahiOne reserves the right to introduce platform fees, convenience charges, subscriptions, or other monetization models in the future. Users shall be notified of such changes in advance through the Platform.

Continued use of the Platform after such notification constitutes acceptance of the revised terms.

IX. FORCE MAJEURE

RaahiOne shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government orders, internet or telecom failures, server outages, or legal or regulatory actions.

X. SERVICE AVAILABILITY & PLATFORM DOWNTIME

RaahiOne does not guarantee uninterrupted or error-free operation of the Platform. Services may be suspended or discontinued due to maintenance, technical issues, regulatory requirements, or app store policies.

RaahiOne shall not be liable for any loss arising from such interruption or discontinuation.

XI. CROSS-BORDER DATA PROCESSING

User data may be stored or processed on cloud servers located outside India. RaahiOne ensures that such processing complies with applicable Indian data protection laws.

By using the Platform, Users consent to such cross-border data processing.

XII. ENHANCED LIMITATION OF LIABILITY

To the maximum extent permitted by law, RaahiOne shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, reputation, business, or data.

RaahiOne’s total aggregate liability shall not exceed INR 1,000.

XIII. LAW ENFORCEMENT & GOVERNMENT DISCLOSURE

RaahiOne may disclose user information, content, or records to government authorities, law enforcement agencies, or courts when required by law or pursuant to a valid legal process, without prior notice to the User.

XIV. ARBITRATION – CLARIFIED

All disputes shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.
